TRECC Electric and the Customer (each defined below), agree as follows:
Services – TRECC Electric shall supply and install the items listed on the Quotes. The Quotes, read together with these terms and conditions constitute "the/this Agreement".
Definitions
After Possession Equipment – means such equipment, supplied by a manufacturer or distributor, including but not limited to televisions, projection screens and
projectors, DVD players, and like equipment which cannot be practically installed until sometime after Customer takes possession of the Property.
Audio Equipment – means such equipment, supplied by a manufacturer or distributor, including but not limited to speakers, controllers, remotes and like equipment to
be installed prior to the Customer taking possession of the Property
Builder – means the general contractor referenced on the Quotes.
Customer - means the person or persons noted as Home Owner on the Quotes
Property – means the dwelling located at the address set out on the Quotes
Quotes – means the TRECC Electric quote or quotes signed and dated by Customer
TRECC Electric means The Residential Electrical Contractor Corporation, a company incorporated in the Province of Alberta;
Payment – Unless the Builder has agreed to assume responsibility for payment of a Quote, the Customer shall pay TRECC Electric the full amount on or before the time specified on the
Quote or Quotes.
If the Customer fails to pay any undisputed amount due and payable to TRECC Electric pursuant to the terms of this Agreement, then TRECC Electric may, without prejudice to any other
rights it may have, suspend the supply and installation of the items in the Quotes until payment is received.
Any amount due to TRECC Electric, which is not paid on its due date, shall attract interest at the rate of 24% per annum.
Pricing – Quotes are valid for 90 days from the date thereof , after which time, TRECC Electric, may at its sole option, provide Customer with a revised quote updating the item
pricing. Customer, at its sole option, can sign, date and remit the difference set out on the revised quote or refuse the quote thereby deleting the quote in its entirety from this Agreement.
Late Changes – Changes, deletions or additions to the Quotes are subject to a $100 charge per change, deletion or addition.
After Possession Equipment – TRECC Electric is not liable to Customer for After Possession Equipment or Audio Equipment which has been discontinued by manufacturer or for whatever
reason manufacturer or its distributor is unable to supply. If After Possession or Audio Equipment is no longer available for order, Customer agrees to promptly select a replacement item and
notify TRECC Electric, in writing, of such selection.
Warranty – TRECC Electric provides a one (1) year warranty for installation defects from the date of final install. Warranties for After Possession and Audio Equipment are limited
to the warranties provided by the manufacturer and/or distributor. TRECC Electric does not expressly or impliedly give any warranty or guarantee in respective of After Possession or Audio
Equipment.
General
This Agreement constitutes the entire Agreement between the Parties with regard to the subject matter hereof.
The Parties choose their respective address for notice hereunder to be the addresses set out in the Quotes. All notices given by any Party shall be in writing and which:
Is delivered by hand shall be deemed to be received by the addressee on the date of delivery;
Is transmitted by facsimilie shall be deemed to be received by the addressee on the first working day after the date of receiving by the receiving
instrument;
If posted by pre-paid registered mail shall be deemed to be received by the addressee on the fifth (5th) working day after the date of such posting;
In the event that any of the terms of this Agreement are found to be invalid, unlawful or unenforceable, such terms shall be severable from the remaining provisions, which
shall remain in full force and effect.
This Agreement shall be governed by, construed and interpreted in accordance with the laws of the Province of Alberta;
If any conflict arises in respect of the provisions contained in these terms and conditions and the Quotes, the provisions contained in these terms and conditions shall
prevail.
Any verbal representations of this Agreement are not valid.
TRECC Electric shall be entitled to collect from Customer reasonable fees and disbursements incurred to enforce the terms of this Agreement.
